6.2 Customer Content: You retain ownership of any content you submit to us (such as design ideas or specifications). However, by submitting such content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for the purpose of providing and improving our Services.

6.3 AI-Generated Designs: The AI-generated designs created through our platform are owned by us. When you purchase a custom piece, you acquire ownership of the physical item but not the intellectual property rights to the design.

7. User Conduct

You agree not to:

  • Use our Services for any illegal purpose
  • Interfere with or disrupt our Services or servers
  • Attempt to gain unauthorized access to any part of our Services
  • Use our Services to transmit harmful code or malware

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID TO US FOR THE SERVICES GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI The Jeweler and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your use of our Services
  • Your violation of any rights of another

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within San Francisco County, California.
